AXEN Logistics s.r.o.’s Policy on the Use of Cookies and Similar Technologies.

Article I

Introductory Provisions

1. This Policy on the Use of Cookies and Similar Technologies (hereinafter referred to as the „Policy“) governs the use of cookies, similar technologies and related analytical, functional and marketing tools on the website of AXEN Logistics s.r.o., with its registered office at Súľovská 5808/21, 040 11 Košice – Západ district, Company Registration Number: 46 027 289, registered in the Commercial Register of the Košice Municipal Court, Section Sro, File No. 27357/V (hereinafter referred to as the „Controller“).
2. The purpose of these Rules is to provide visitors to the website with information on the use of cookies and similar technologies, the purposes for which they are used, the legal bases for the processing of the relevant data, options for managing cookie settings, and users’ rights.
3. Cookies and similar technologies may be used, in particular, for:
   (a) ensuring the proper functioning of the website,
   (b) ensuring the technical operation and security of the website,
   (c) storing user settings,
   (d) an analysis of website traffic and usage,
   (e) measuring the performance of the website and marketing campaigns,
   (f) the personalisation of content or marketing communications, provided there is an appropriate legal basis for doing so.
4. The use of certain cookies and similar technologies may involve the processing of personal data. Detailed information on the processing of personal data is set out in the document „AXEN Logistics s.r.o. Privacy Policy“, published on the Controller’s website.
5. The controller uses cookies and similar technologies in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), Act No. 18/2018 Coll. on the protection of personal data and amending certain acts, as amended, Act No. 452/2021 Coll. on Electronic Communications, as amended, and other relevant legislation.
6. Visitors to the website may adjust their cookie settings or withdraw their consent at any time via the cookie banner, the relevant consent management tool or their web browser settings.

Article II

Cookies and similar technologies

1. Cookies are small text files stored on a user’s device when they visit a website. Cookies enable a website to recognise the user’s device, remember certain information about their visit, or ensure that the website’s various features function correctly.
2. In addition to cookies, the Controller may also use other similar technologies, in particular:
   (a) pixel markers (pixels),
   (b) tracking tags,
   (c) web beacons,
   (d) local storage in a web browser (Local Storage or Session Storage),
   (e) third-party analytics and marketing tools,
   (f) other technologies that enable the collection or storage of information on the use of the website.
3. For the purposes of these Rules, the term „cookies“ is also used as a collective term for cookies and similar technologies, unless the context indicates otherwise.
4. Cookies may be stored:
   (a) only for the duration of the visit to the website (session cookies), which are automatically deleted when the web browser is closed,
   b) for a longer period, as determined by their settings (persistent cookies), and they remain stored on the user’s device even after they have left the website.
5. Cookies may be created:
   (a) directly by the Controller (first-party cookies),
   (b) third parties whose services or tools are used on the website (third-party cookies).
6. Information obtained through cookies may include, in particular:
   (a) an IP address or part thereof,
   (b) information on the equipment used,
   (c) information about the web browser,
   (d) data on visits to and use of the website,
   (e) the user’s preferred settings,
   (f) data on the user’s interaction with the website’s content.
7. Cookies and similar technologies do not, in themselves, allow a specific natural person to be identified unless they are linked to other data that may constitute personal data under the GDPR.
8. The scope of the cookies used, their specific purposes, retention periods and any providers are set out in the cookie banner, the consent settings or in further information published on the Controller’s website.

Article III

Types of cookies used and their purposes

1. The operator may use various types of cookies and similar technologies on the website, depending on their purpose, technical nature and function.
2. Essential cookies are those required to ensure the basic functions of the website and its secure operation. Without these cookies, the website or parts of it may not function correctly. As a general rule, the user’s consent is not required for the use of essential cookies, provided that this is permitted under the relevant legislation.
3. Functional cookies enable the website to remember the user’s preferences and settings, improve the user experience and provide enhanced website functionality. These cookies may only be used with the user’s consent where required by law.
4. Analytical cookies are used to collect statistical and analytical data on website traffic, user behaviour and the use of individual website features. The data collected via analytical cookies helps the Controller to improve the content, functionality, performance and security of the website.
5. Marketing cookies may only be used with the user’s prior consent, unless otherwise provided for by the relevant legislation.
6. The operator may also use third-party cookies provided by external partners or service providers, particularly in the following areas:
   (a) web analytics,
   (b) traffic measurement,
   (c) marketing and advertising,
   (d) managing cookie consent,
   (e) to secure and protect the website,
   (f) the integration of external content or services.
7. The specific range of cookies used may change from time to time depending on technical developments to the website, the services provided or the third-party tools used. Up-to-date information on the cookies used is made available to the user via the cookie banner, the cookie settings centre or another similar tool used on the website.
8. The operator uses only those cookies and similar technologies that are proportionate to the purpose for which they are used and comply with the applicable legislation governing the protection of personal data and electronic communications.

Article IV

The legal basis for the use of cookies and similar technologies

1. The controller uses cookies and similar technologies in accordance with applicable legislation, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR), Act No. 18/2018 Coll. on the protection of personal data, and Act No. 452/2021 Coll. on electronic communications.
2. Essential cookies, which are necessary to ensure the functioning of the website, its security, stability or the provision of a service expressly requested by the user, may be used without the user’s consent, provided that this is permitted under the relevant legislation.
3. Functional, analytical, marketing and other cookies that are not essential for the operation of the website, are generally used by the operator only on the basis of the user’s prior consent, given via a cookie banner or another consent management tool.
4. Consent to the use of cookies is voluntary. Users are not obliged to consent to the use of analytical, marketing or other non-essential cookies, and failure to give such consent does not affect their ability to use the website’s basic functions.
5. The user is entitled to withdraw or amend their consent to the use of cookies at any time via the cookie settings available on the website or via their web browser settings. Withdrawal of consent does not affect the lawfulness of processing carried out prior to such withdrawal.
6. Where personal data is processed via cookies or similar technologies, the legal basis for such processing may include, in particular:
   (a) the data subject’s consent pursuant to Article 6(1)(a) of the GDPR,
   (b) the Controller’s legitimate interests pursuant to Article 6(1)(f) of the GDPR, where this concerns essential or security-related technologies and the law permits such a procedure,
   (c) compliance with the Controller’s legal obligations, where such processing is required by the relevant legislation.

Article V

Managing cookie settings

1. Users have the right to decide whether to accept cookies and similar technologies that are not essential for the operation of the website.
2. On their first visit to the website, users are given the option, via a cookie banner or similar tool, to:
   (a) to consent to all cookies,
   (b) to reject all non-essential cookies,
   c) configure the use of individual categories of cookies according to your own preferences.
3. Users may change their cookie settings at any time or withdraw their consent via the link to the cookie policy available on the website or via any other technical solution used by the Controller.
4. Users can also restrict or block the use of cookies via their web browser settings. Cookie management settings may vary depending on the web browser or device used.
5. Restricting or blocking certain types of cookies may result in the website’s functionality being limited or the user experience being reduced.
6. Withdrawing consent to the use of cookies does not affect the lawfulness of any processing carried out prior to such withdrawal.
7. The operator may, either on a regular basis or in the event of a significant change to the cookies used, display a prompt to the user once again to grant or update their consent to the use of cookies.
8. The current cookie settings, the scope of the consents given and the categories of cookies used are available to the user via the cookie management tool on the Controller’s website.

Article VI

Third-party cookies and external tools

1. In operating the website, the operator may use services, applications or tools provided by third parties, which may use their own cookies or similar technologies to collect information about the use of the website.
2. These tools can be used in particular for:
   (a) an analysis of website traffic,
   (b) measuring the performance and functionality of the website,
   (c) the management of marketing and advertising campaigns,
   (d) measuring the effectiveness of marketing activities,
   (e) ensuring the technical operation of the website,
   (f) the management of user consents,
   (g) protecting the website and preventing security incidents.
3. The operator may, in particular, make use of the services provided by the following companies:
   (a) Google,
   (b) Meta,
   (c) LinkedIn,
   (d) Microsoft,
   (e) providers of analytical, marketing, cloud or security solutions, or other providers of similar services.
4. The use of specific third-party tools may change over time depending on the Controller’s technical, operational or marketing needs. The tools currently in use and the categories of cookies are made available to the user via the cookie banner, the cookie settings centre or another consent management tool.
5. Where personal data is processed via third-party tools, such processing is carried out in accordance with the GDPR and other relevant legislation. Further details on the processing of personal data are set out in the document „AXEN Logistics s.r.o. Privacy Policy“.
6. Some third-party service providers may process data outside the European Economic Area. In such cases, the Controller takes appropriate measures to ensure the protection of personal data in accordance with the GDPR, in particular by making use of adequacy decisions, standard contractual clauses or other legal mechanisms recognised by European Union legislation.
7. The operator is not responsible for the content, data processing terms or privacy policies of third parties. Users are advised to familiarise themselves with the terms and privacy policies of the relevant third-party service providers.

Article VII

Final Provisions

1. This Policy on the Use of Cookies and Similar Technologies governs the use of cookies and similar technologies on the Controller’s website and supplements the document „Privacy Policy of AXEN Logistics s.r.o.“.
2. The Operator is entitled to amend or supplement these Rules as appropriate, in particular for the following reasons:
   (a) changes to legislation,
   (b) changes to the technologies used,
   (c) changes to the website’s functionality,
   (d) changes to the services provided,
   (e) changes to the analytical, marketing or security tools used.
3. The current version of these Rules is published on the Operator’s website.
4. If any provision of these Rules becomes or is deemed to be invalid, ineffective or unenforceable, this shall not affect the validity, effectiveness or enforceability of the remaining provisions of these Rules.
5. Matters not covered by these Rules shall be governed by the relevant legislation of the Slovak Republic and the directly applicable legislation of the European Union, in particular the GDPR and the legislation governing electronic communications.
6. These Rules shall come into force and take effect on 24 June 2026.
